Adoption of the laws by the Parliament

  1. The Law of Ukraine “On Amendments to the Law of Ukraine “On the Corporate Profit Tax” , dated 24 December 2002, under No. 349-IV, improved procedures for corporate profit taxation of operations involving the furnishing (receipt) of financial assistance, brought into order the definition of “usual prices”, introduced methods for the calculation of usual prices, expanded a list of groups of fixed assets that are subject to depreciation simultaneously with a change to tax depreciation rates, reduced the rate of the corporate profit tax from 30 to 25 per cents as from the 1 st of January 2004;
  2. The Law of Ukraine “On the Personal Income Tax”, dated 22 May 2003, under No. 889-IV, changed cardinally the personal income taxation system, encouraged an increase and legalization of income earned by individuals through, in first place, a decrease of the tax rate to 15% (during the transition period of 3 years the tax rate was equal to 13%), expanded social benefits and cancelled tax benefits by professional features;
  3. The Law of Ukraine “On Electronic Digital Signatures”, dated 22 May 2003, under No. 852-IV, defines the legal status of electronic digital signatures and governs issues and matters arising in the course of use of electronic digital signatures;
  4. The Law of Ukraine “On Electronic Documents and Electronic Circulation of Documents”, dated 22 May 2003, under No. 851-IV, defined principal organizational and legal foundations for electronic circulation of documents and use of electronic documents.

The Law of Ukraine “On Amendments to the Law of Ukraine “On the Value Added Tax” contemplates to extend until the 1 st of January 2008 the mechanism of support of producers of meat and dairy products and the mechanism of VAT accumulation; elimination of the special taxation regime for agricultural producers.

The Law of Ukraine “On Amendments to Article 8 of the Law of Ukraine “On Protection of Rights to Indication of Origin of Goods” provides for protection in Ukraine of foreign geographic indications of origin of goods.

The Law of Ukraine “On Amendments to Article 25 of the Law of Ukraine “On Publishing” cancels the limitations on foreign capital with regard to services concerned with the dissemination of printed materials over a 5-year transition period as of the date of Ukraine’s accession .

The Law of Ukraine “On Amendments to Article 7 of the Law of Ukraine “On Pesticides and Agrochemicals” sets a 10-year period for protection of undisclosed information .

The Law of Ukraine On Amendments to the Law of Ukraine “On the Export Duty for Live Cattle and Leather Raw Materials” establishes rates of the export duty for live cattle at the level of 50% of the customs value with a gradual annual reduction of 5% until the 10% level has been achieved, and establishes rates of the export duty for skins and leather raw materials at the level of 30% of the customs value, with a gradual annual reduction of 1% until the 20% level has been achieved.

The Law of Ukraine “On Foreign Economic Activities” deletes the definitions that do not comply with the WTO requirements, in particular “antidumping quotas”, “countervailing quotas”, “antidumping license”, “countervailing license” etc.

The Law of Ukraine “On Amendments to the Law of Ukraine “On Veterinary Medicine” brings Ukrainian law in the area of veterinary control in line with international standards and the requirements of WTO Agreements .

The Law of Ukraine “On Amendments to the Law of Ukraine “On Medical Drugs” introduces an additional 5-year period for the protection of undisclosed information in case of registration of pharmaceuticals .

The Law of Ukraine “On Amendments to the Customs Code of Ukraine” provides for a new wording of the definition “counterfeiting goods” and amends Section X in the Code pursuant to Article 58 of the Agreement on Trade-Related Aspects of Intellectual Property Rights .

The Law of Ukraine “On Amendments to the Law of Ukraine “On Insurance” contemplates : cancellation of limitations on intermediary activities in Ukraine related to conclusion of insurance agreements with foreign insurers over a 5-year transition period as of the date of Ukraine’s accession to the WTO; permission for reinsurance by foreign insurers of insurance against risks related to sea transportation, commercial aviation, and space launches (including satellites) as of the date of Ukraine’s accession to the WTO.

The Law of Ukraine “On Amendments to the Law of Ukraine “On the Bar” gives a right to foreign attorneys to practice law in Ukraine.

The Law of Ukraine “On Amendments to the Law of Ukraine “On Banks and Banking” permits the inclusion of branches of foreign banks into the Ukrainian banking system .

The Law of Ukraine “On Amendments to certain Laws of Ukraine reduces the cost of license fees for the manufacture and sale of spirits, alcoholic beverages and tobacco products .

The Law of Ukraine “On Amendments to the Law of Ukraine “On Export Duties for Waste Ferrous Metals” provides for the reduction of the export duty from EURO 30 to EURO 10 per 1 ton over a 6-year period as of the date of Ukraine’s accession to the WTO .

The Law of Ukraine “On Amendments to the Law of Ukraine “On Milk and Dairy Products” excludes the provisions in respect of support of exports of dairy products; cancels the application of quotas for production and minimal prices for agricultural products .

The Law of Ukraine “On the Establishment of the Tariff Rate Quota for Imports of Raw Cane Sugar into Ukraine” provides for the establishment of an annual tariff quota in the amount of 260,000 tons for imports of raw cane sugar into Ukraine.

The Law of Ukraine “On Amendments to the Law of Ukraine “On State Support of Agriculture in Ukraine ” brings certain legal rules into conformity with the WTO requirements in the part relating to regulation of import and export operations involving the subject matter of state price regulation.

The Law of Ukraine “On Amendments to the Law of Ukraine “On State Regulation of Production and Sale of Sugar” (in respect of exclusion of the definitions of export quotas B and C from the mechanism of domestic regulation of the sugar market) excludes the definitions of the export quotas B and C in the mechanism for the regulation of domestic production of sugar as well as requirements for mandatory exportation of sugar produced from imported raw materials.

The Law of Ukraine “On the Establishment of Export Duty Rates for Waste and Scrap of Ferrous Alloy Metals, Non-Ferrous Metals and Semi-Finished Products Manufactured with their Use” introduces an export duty for waste of alloyed steel, non-ferrous metals and some items (semi-products) manufactured with the use thereof, and a gradual reduction of export duty rates over a 6-year period as of the date of accession to the WTO; introduces a 5-year transition period, during which exports of goods (semi-finished products) manufactured as a result of processing of waste of non-ferrous metals, their alloys and non-ferrous metal products will be carried out exclusively by specialized metallurgical processing enterprises that have manufactured these products, provided that these enterprises have an export quality certificate .

20.

The Law of Ukraine “On Amendments to the Law of Ukraine “On Amendments to certain Legislative Acts of Ukraine ” contemplates:
elimination of a 5-year transition period, during which it was prohibited to import motor vehicles aged more than 8 years; application of a differentiated rate of the tax (depending on the age of motor vehicles) payable by owners of the motor vehicles at the time of registration etc.
